Yesterday, the National People’s Congress adopted a new civil code describing various civil rights, including the right to inherit the digital property of the deceased.
According to Professor Lixin Yang of the People’s University of China, the civil code defines “inheritance” as “private and legal property owned by the deceased”. And since China recognizes digital rights and cryptocurrencies as private property, it means they fall under the law of inheritance.
“China’s inheritance law has been expanded to include digital and cryptographic inheritance, including Bitcoins. Although, I would prefer my bitcoins to be protected by a secret key rather than the law, as there are always problems with the law,” said Dovey Wan, partner at Primitive Ventures, on Twitter.
The new Civil Code will enter into force on 1 January 2021.
